On September 10, 1999 morning at 8:30 the Council of Ministers convened a plenary cabinet meeting, presided over by H.E. Sar Kheng Deputy Prime Minister of Royal Government of Cambodia in order to review and pass:

  1. Draft on declaration concerning the elimination of anarchy in encroachment of land occupation.
  2. Draft law on overall state budgetary audit for 1998 management.
  3. Others.

After the active discussions and view exchanging the cabinet achieved the results as follows:

Draft on declaration concerning the elimination of anarchy

in encroachment of land occupation

The cabinet approved the draft on declaration concerning the elimination of anarchy in encroachment of land occupation in the aim of strengthening effective control and focussing land on a target use. In this declaration, such immediate measures have been set out as no private ownership on state lands – forestry reserve boundary, fishing boundary, reservoir for irrigating nature-protecting zones, national parks, wild animal shelter boundary, inundated forests, mangrove lands, replanted forest plantations, rubber plantations, agricultural technique stations and centres, mine centre compounds, cultural heritages centres, pagodas, schools, reserve lands, lands for railway purpose, investment companies’ lands and legal private lands across the country; and urgently stop encroachment activities of land occupation as mentioned above as well as other lands which are state public property and state private property.

Draft law on overall state budgetary audit for 1998 management

The Cabinet approved the draft sub-decree, and to strengthen the control of public finance, the Royal Government has set out some technical measures and procedures as follows:

  1. Increase revenue collection through effective practice of value added tax, eliminate tax exemption, expand taxation bases, strengthen inspection on the spot, improve taxation administration, fight against corruption and consolidate good governance.
  2. Improve customs and duty administrations through the consolidation of PSI inspection mechanism, eliminate the exemption from PSI and expand the immensity of PSI imported items.
  3. Thoroughly implement the Prime Minister’s orders dated December 25, 1997 on the control of state property.
  4. Increase cooperation between taxation and customs institutions and Cambodian Development Council- Cambodian Investment Committee in order to require the private companies to pay debts before obtaining encouragement advantages for their investment projects. The Royal Government will continue to strengthen the mechanism and develop it into a joint tax identity card system in the country.
  5. Increase public expenditure in the sectors of health, education, agriculture and rural development.
  6. Continue the reform of budgetary management by consolidating and expanding the role of ordonnateur in the control and provision of budgetary credit.
  7. Implement Public Expenditure Program in the period of average time.
  8. Fight against corruption and extravagance, reinforce public governance and transparency by means of enacting some laws such as a law on determination and responsibility of those who manage public cash, and an audit law.

Others

The Cabinet decided as follows:

  1. Pursuant to article 20 of the constitution of Kingdom of Cambodia, stipulating that His Majesty the King receives official audiences twice a month, allowing the Prime Minister and Cabinet to meet in order to inform him about the situation of the country; the Royal Government has contacted H.E. Kong Sam ol - Deputy Prime Minister and Minister of Royal Palace- so as to provide His Royal Highness with the report documents monthly.
  2. In addition, the cabinet will invite H.E. Kong Sam ol to attend the Cabinet meeting in the near future.

  3. The Cabinet asked Cambodian National Bank to keenly follow the evolution and fluctuation of riel rate exchange on the market in Kingdom of Cambodia and then report to the Royal Government.

The Cabinet meeting ended at 12:30pm.
